WHY DEBT REVIEW?
About The Process
The debt review process was introduced in 2007, with the National Credit Act (NCA). The benefit is that, while you’re getting debt counselling and in the process of paying off your debts – legal action cannot be taken against you.
Bear in mind that you can only take advantage of this process if you have a regular income to develop a reasonable repayment plan, and you have to be ‘over-indebted’ to qualify for a Debt Review (ie: monthly expenses are greater than your income).
Once a consumer has made an application for Debt Review, Credit Providers can no longer attach any assets or take any further legal action against the Consumer pending a determination by a Debt Counsellor as to whether or not the consumer is actually ‘over-indebted’.
Should the Consumer be ‘over-indebted’ – then he/she will continue under Debt Review until all debt is settled.
There is no permanent record of being under Debt Review kept on any Consumer Credit Bureau Database. In other words, unlike Administration or other avenues – the Debt Review process leaves no black mark against your name.
One Monthly Repayment
Repayment of your debt obligations is done through one regular monthly payment (to a Payment Distribution Agency who will handle the money side of things).
The Payment Distribution Agency will then pay all of your creditors. This one easy payment will make your finances much easier to manage and reduce your banking fees.
The Debt Counsellor sets aside a certain amount of income for your necessities (food, school fees, transport costs etc) and you can then use whatever money you have left over to pay off your debts.
You will never pay more money than you can reasonably afford.

THE DEBT COUNSELLING PROCESS
We found that potential debt review applicants need and want to know the steps of the debt review process.
Below we made a short summary for you, to provide you with some indication of what to expect.
You complete an application form and provide us with the details of all your Credit Providers.
(Consultations are confidential and can be done in person)
We assess your application and determine whether you are ‘over-indebted’. In other words – does your monthly expenses exceed your monthly income?
You have to be ‘over-indebted’ to qualify for Debt Review.
If you are ‘over-indebted’ – we shall inform all of your Credit Providers and the Credit Bureaus that you are under Debt Review.
Your Credit Providers will also be requested to provide us with a Certificate of Balance (COB) in respect of your accounts.
( You will immediately start to pay a single provisional reduced monthly instalment in respect of all your Credit Providers, which will be affordable to you. During the first 60 working days, legal action may not be taken against you in respect of the debts that are under review. )
After receiving all COB’s – we will restructure your payment plan and negotiate with your Credit Providers where necessary.
After negotiations with your Credit Providers, your new restructured payment plan will be sent to all of your Credit Providers and this payment plan will take effect.
( Your restructured payment plan will reduce your monthly debt repayments to an affordable amount, leaving you with sufficient money for your living expenses. )
We will instruct our specialist attorneys to apply at court in order to make your restructured payment plan a court order.
You will not have to appear in court yourself, as your Debt Counsellor will be the applicant in the matter.
( The process will now be completed and you must ensure that your monthly payments are made timeously in order to prevent Credit Providers from taking action against you. )
